Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Aperture platform operated by Aperture ("we," "us," or "our"). By creating an account or using the platform, you agree to be bound by these Terms.

1. Definitions

  • "Platform" refers to the Aperture web application at getaperture.app, including all subdomains and custom domains configured by organizers.
  • "Organizer" refers to a business or individual who creates an account to host events and sell tickets through the platform.
  • "Attendee" refers to any person who purchases tickets, registers for events, or otherwise participates in events listed on the platform.

2. Accounts

To use organizer features, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized access.

3. Platform Services

Aperture provides event organizers with tools to:

  • Create and publish events with ticket types and pricing
  • Sell tickets and process registrations for free events
  • Manage guest lists and check-in attendees
  • Access business insights and analytics about their events
  • Send transactional emails (confirmations, post-event follow-ups)

We reserve the right to modify, suspend, or discontinue any part of the platform at any time with reasonable notice to active organizers.

4. Subscriptions and Billing

Organizer accounts are subject to subscription plans with varying feature access. Subscription fees are billed monthly through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial billing periods.

5. Payments and Stripe Connect

Ticket sales revenue is processed through Stripe and deposited directly into the organizer's connected Stripe account. Aperture does not hold, escrow, or have access to ticket sale funds. Each organizer is responsible for their own Stripe account, tax obligations, and compliance with Stripe's terms of service.

Aperture is not a party to the transaction between organizers and attendees. Refund policies are set and managed by each organizer.

6. Organizer Responsibilities

As an organizer, you agree to:

  • Provide accurate event information (dates, times, venues, descriptions, pricing)
  • Honor tickets and registrations made through the platform
  • Handle refund requests in accordance with your stated refund policy
  • Comply with all applicable laws and regulations, including consumer protection, tax, and accessibility requirements
  • Not use the platform to host events that promote illegal activity, discrimination, or violence

7. Attendee Responsibilities

As an attendee, you agree to:

  • Provide accurate personal information when purchasing tickets or registering
  • Comply with event rules and venue policies
  • Direct refund requests to the event organizer, not to Aperture

8. Intellectual Property

The Aperture platform, including its design, code, features, and branding, is owned by Aperture and protected by applicable intellectual property laws. Organizers retain ownership of their event content (descriptions, images, branding) uploaded to the platform.

By uploading content, you grant Aperture a non-exclusive, royalty-free license to display that content on the platform for the purpose of promoting your events.

9. Limitation of Liability

To the maximum extent permitted by law, Aperture shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. This includes, but is not limited to, loss of revenue, lost profits, loss of data, or business interruption.

Aperture's total liability for any claim arising from or related to these Terms shall not exceed the amount you paid to Aperture in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Aperture, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the platform, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law. Upon termination, your right to use the platform ceases immediately. We will make reasonable efforts to allow you to export your event data before account deletion.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the platform shall be resolved through binding arbitration or in the courts of competent jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. We will notify registered organizers of material changes via email at least 30 days before they take effect. Continued use of the platform after changes become effective constitutes acceptance of the revised Terms.
